The SIJS process first requires a finding by a family court judge that the individual has in fact been abandoned, abused, or neglected, and that it is not in their best interest to return to their home country. Once the finding has been made by the family court, the application for SIJS can be submitted to immigration. Upon approval, the applicant can apply for a work permit and will be on the path to residency and citizenship.
